WAIVER OF
LIABILITY AND ASSUMPTION OF RISK AGREEMENT
Waiver
I
the undersigned, realize danger exists in my participation in canoeing,
kayaking and all other water sports/activities. I am in sufficient health to be
able to participate in such activities and assume full responsibility for my
safety and the safety of any minor accompanying me. I realize that my
participation may result in illness or injury due to accidents, the forces of
nature, mistakes in judgement, carelessness or many other
foreseeable and/or not foreseeable causes. I understand that I take full
responsibility for making an independent judgement whether to participate and
continue participating in any activity. In consideration for
participating in all Whatcom Canoe Club (hereinafter the “Club”) activities, I
hereby waive any claim for damages against the “Club”, and/or its officers,
and/or fellow participants and/or club members.
I
also understand that I assume full responsibility for any and all minor(s) who
are included within this membership and/or accompany me during any “Club”
activities. Therefore, on behalf of these minor(s), I hereby waive their claims
for any damages against the “Club”, and/or its officers, and/or fellow
participants and/or “Club” members.
Minor(s) are defined as any child under
eighteen (18) years of age.
Release of Liability
In
consideration for receiving the benefits of membership in the Whatcom Canoe
Club (hereinafter the “Club”), I hereby, on behalf of myself, my personal
representatives and my heirs, release and hold harmless the Whatcom Canoe Club
and its officers, members, agents, coaches, instructors, other participants,
sponsors, and owners of premises used from any and all claims and suits for
bodily injury, property damage, wrongful death and/or personal injury which
arises out of my participation in “Club” activities. I also release and hold
harmless the “Club” and its officers, its members and agents from any and all
claims and suits for bodily injury, property damage, wrongful death or personal
injury which arises out of any and all minor(s) under my responsibility
participating in “Club” activities.
I
HAVE READ THE ABOVE WAIVER AND RELEASE OF LIABILITY AND UNDERSTAND THAT I HAVE
GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT.
